Terms and Conditions
Introduction
This purchase is regulated by the standard terms and conditions below for consumer purchases of goods over the Internet. Consumer purchases over the Internet are primarily governed by the Contract Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, and the E-commerce Act, which provide consumers with non-waivable rights. These laws are available at www.lovdata.no. The terms of this agreement should not be understood as limiting statutory rights, but rather outlining the parties’ key rights and obligations in the transaction.
The sales conditions have been prepared and recommended by the Norwegian Consumer Authority. For a better understanding of these sales conditions, see the Consumer Authority’s guide here.
The agreement consists of these sales terms, information provided in the ordering system, and any specially agreed terms. In the event of conflict, special agreements between the parties take precedence, provided they do not violate mandatory legislation.
The agreement will also be supplemented by relevant legal provisions that regulate purchases of goods between businesses and consumers.
The seller is Ulvik Vass-ski Klubb, a non-profit and non-commercial organization registered in the Brønnøysund Register with organization number 983782892, email ulvikvannski@gmail.com, and is referred to as the seller.
The buyer is the consumer who places the order, and is referred to as the buyer.
The price stated for the goods and services is the total price payable by the buyer. This price includes all taxes and additional costs. Additional costs not disclosed before the purchase shall not be borne by the buyer.
The agreement is binding for both parties when the buyer has submitted their order to the seller.
However, the agreement is not binding if there has been a writing or typing error in the seller’s offer in the online store or in the buyer’s order, and the other party realized or should have realized that such an error existed.
The seller may demand payment for the goods from the time they are ordered. The payment solution is provided through Easy Nets.
If the buyer uses a credit or debit card, the seller may reserve the purchase amount on the card at the time of ordering. The card is charged the same day the item is ordered.
For invoice payments, please contact us via email or the contact form.
Delivery has occurred when the buyer, or their representative, has used the sauna service or taken possession of the item.
The delivery time for sauna bookings appears in the booking system.
The risk for the goods transfers to the buyer when they, or their representative, have received the goods in accordance with point 6.
RIGHT OF WITHDRAWAL
The right of withdrawal for services does not apply to single services that take place at a specific time or within a specific period, cf. the Right of Withdrawal Act § 19. A booking with Moss Folkebadstue follows the same principles as the purchase of concert tickets, theatre performances, sports events, etc. Reservations can be transferred to another person free of charge.
PRIVATE BOOKINGS
Bookings may be cancelled or changed no later than 72 hours before the scheduled session.
If you cancel on time, you may choose between a 50% refund to your bank account or 100% refund as a gift card.
SINGLE TICKETS
Bookings may be moved no later than 48 hours before the scheduled session. Single tickets for shared sauna/rituals are refundable only as a 100% gift card refund if cancelled within the applicable deadline.
GIFT CARDS AND RIGHT OF WITHDRAWAL
When purchasing gift cards online, the customer always has a 14-day right of withdrawal under the Right of Withdrawal Act. We will refund the amount using the same payment method used during purchase.
All gift cards are valid for one year from the purchase date and cannot be extended. The booking and sauna visit must also occur within the validity period. Only one gift card may be used per booking, and multiple gift cards cannot be combined. Gift cards may only be used for single tickets and private sauna bookings.
CANCELLATION AND WEATHER CONDITIONS
In cases of extreme weather or other force majeure events such as natural disasters, strikes, or lockouts, the customer will not be refunded for services that cannot be carried out.
If the seller does not deliver the item or delivers late according to the agreement, and the delay is not due to the buyer, the buyer may—with reference to the Consumer Purchases Act, chapter 5—depending on the situation, withhold payment, demand fulfilment, cancel the purchase, and/or claim compensation.
Claims should be made in writing for documentation purposes (e.g. email).
Fulfilment
The buyer may demand delivery unless an insurmountable obstacle exists or fulfilment entails unreasonable inconvenience or cost for the seller.
Cancellation
The buyer may cancel if the seller does not deliver within a reasonable additional deadline. Immediate cancellation is possible if the seller refuses to deliver or if timely delivery was essential to the agreement.
Compensation
The buyer may claim compensation for losses caused by the delay unless the seller proves the delay was due to circumstances beyond their control.
If the buyer does not pay or fulfil other obligations under the agreement or the law, and this is not due to the seller, the seller may—according to the Consumer Purchases Act, chapter 9—depending on the situation, withhold goods, demand fulfilment, cancel the agreement, and/or claim compensation. The seller may also claim interest, collection fees, and reasonable fees for uncollected goods.
The seller is the data controller for collected personal data. Unless the buyer consents otherwise, the seller may only collect and store personal data necessary to fulfil obligations under the agreement. Buyer information is only disclosed when necessary to fulfil the agreement or when required by law.
Complaints must be submitted to the seller within a reasonable time, cf. sections 9 and 10. The parties shall attempt to resolve disputes amicably. If unsuccessful, the buyer may contact the Norwegian Consumer Authority for mediation. The Consumer Authority may be reached at telephone 23 400 600 or via www.forbrukertilsynet.no.
